Preamble

These Terms and Conditions (“Terms”) constitute a legally binding agreement between Arabian Desert Safari LLC (also referred to as “Arabian Desert Safari,” “ADS,” “we,” “our,” or “us”), a limited liability company incorporated and registered under the laws of the United Arab Emirates, holding Trade License No. 216850 issued by the Department of Economy and Tourism (DET / DTCM) in Dubai, and the customer (“you” or “your”) who makes a booking or uses our services through our websites, including but not limited to www.arabiandesertsafari.net, associated booking engines, mobile applications, and any affiliated or successor websites (collectively, the “Website”), as well as our specialized group entities including Arabian Desert Safari, All UAE Tours, Royal Desert Tours, and DTTS (Dream Tourism & Transport Solutions).

By making a booking through our Website, directly with our reservation team, or via authorized partners, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. These Terms shall apply to all bookings, desert safaris, tours, excursions, attractions, luxury transfers, car rentals, chauffeur services, hotel accommodations, holiday packages, corporate events, and ancillary travel services (“Services”) offered by Arabian Desert Safari LLC.

We strongly advise you to read these Terms carefully before completing any booking. If you do not agree with any provision herein, you should refrain from making a booking or using our Services.

1. Pricing

1.1 Unless otherwise expressly stated, all prices quoted on our Website are on a per-person basis (or per-vehicle basis for private transfers/charters), denominated in the currency indicated at the point of sale (default United Arab Emirates Dirhams / AED), and are inclusive of applicable Value Added Tax (VAT) where required by UAE law.

1.2 Published prices are exclusive of the following, unless specifically stated otherwise in the tour inclusions:

• Gratuities and tips to tour guides, drivers, safari marshals, or service personnel
• Passport fees and related consular or government charges
• Travel and medical insurance premiums
• Personal food, alcoholic beverages, and discretionary consumption items not included in the package
• Hotel accommodation, room service charges, and laundry services (unless forming part of a designated holiday package)
• Optional adventure add-ons (such as quad bikes, dune buggies, VIP seating upgrades, and private photography services)
• Any additional services not expressly itemized in the confirmed tour voucher

1.3 Arabian Desert Safari LLC reserves the right to amend published prices at any time without prior notice, including but not limited to circumstances involving increases in supplier costs, fuel surcharges, venue admission rates, government taxes, or foreign currency exchange fluctuations. Any such price adjustment shall not affect bookings that have already been confirmed and paid in full.

1.4 In the event of a manifest pricing error on our Website (e.g., an incorrect rate displayed due to a technical glitch, typographical mistake, or system discrepancy), Arabian Desert Safari LLC reserves the right to cancel the affected booking and offer you a prompt, full refund, or the opportunity to rebook at the verified, correct price.

2. Methods of Payment

2.1 Arabian Desert Safari LLC accepts electronic payments through major credit and debit cards, including Visa, MasterCard, American Express, and other secure payment solutions made available on the Website or via secure payment links.

2.2 Full payment is required at the time of booking confirmation unless otherwise agreed in writing for corporate MICE groups. You are required to provide valid, accurate, and authorized payment details to complete transactions. By submitting payment information, you represent and warrant that you are legally authorized to use the chosen payment method.

2.3 All transactions are processed in the currency specified at the point of sale. Where currency conversion is required by your card-issuing bank, the applicable exchange rate and any foreign transaction fees are determined exclusively by your financial institution, and Arabian Desert Safari LLC bears no liability for exchange rate variations or bank surcharges.

2.4 All charges will appear on your credit or debit card statement under the merchant name of Arabian Desert Safari LLC or its authorized acquiring payment gateway entity.

3. Booking Confirmation & Vouchers

3.1 Upon successful verification of payment, Arabian Desert Safari LLC shall issue a digital booking confirmation and electronic tour voucher to the email address provided during checkout. This confirmation serves as your proof of purchase and evidence of the contracted Services.

3.2 You are solely responsible for ensuring that all information provided during the booking process—including guest legal names, contact numbers, active WhatsApp numbers, hotel pickup addresses, and specific dates—is accurate and complete. Arabian Desert Safari LLC cannot be held liable for delays, missed transfers, or disruptions arising from inaccurate information supplied by the customer.

3.3 A printed or digital copy of the booking voucher (on smartphone or tablet) must be presented to our safari marshals, chauffeur drivers, or tour guides at the commencement of the service. Failure to provide a valid voucher may result in denial of service without entitlement to a refund.

4. Cancellation and No-Show Policy

4.1 General Cancellation Terms: Each tour, safari excursion, attraction ticket, private transfer, and holiday package is subject to specific cancellation windows, which are clearly displayed on the product page and checkout screen. Generally:

• Standard Tours & Desert Safaris: Cancellations made at least 24 hours prior to scheduled tour departure time are eligible for a full refund or free rescheduling, unless otherwise stated.
• Cancellations within 24 Hours: Cancellations made less than 24 hours prior to tour departure are subject to a 100% cancellation charge.
• Attraction Tickets: Admission tickets (including Burj Khalifa, theme parks, museums, and water parks) are strictly non-refundable and non-transferable once issued, as venues operate strict non-cancellation policies.

4.2 Combo Tour Cancellations: Where a booking comprises a combination of activities or services offered at a bundled package rate (“Combo Tour”), the entire Combo Tour may be cancelled subject to the applicable cancellation window. If an individual component within a combo booking is cancelled by the guest, the package discount is forfeited; the remaining non-cancelled services will be recalculated at standard individual retail prices, and any refund due shall equal the difference between the amount paid and the recalculated total.

4.3 Combo & Tour Availability: All combo tours and individual activities are subject to operational availability. In the rare event that a specific component is unavailable due to venue maintenance, weather conditions, or operational restrictions, you shall be entitled to an alternative equivalent service or a pro-rata refund for the unavailable component.

4.5 No-Show Policy: If a guest fails to appear at the designated pickup point, hotel lobby, or activity departure venue at the confirmed time (“No-Show”), no refund shall be issued, whether in part or in full. This applies to all unused tickets, desert safari pickups, private transfers, luxury limousine hires, city sightseeing tours, and airport transfers. Rescheduling in the event of a No-Show is strictly at the sole discretion of Arabian Desert Safari LLC management and may incur re-dispatch fees.

5. Cancellation Procedures & Refunds

5.1 All cancellation and amendment requests must be submitted in writing via email to contact@arabiandesertsafari.net, through our website customer portal, or via our official helpline at +971 54 474 7041, referencing your unique booking confirmation number.

5.2 Upon receipt of a valid cancellation request, Arabian Desert Safari LLC will acknowledge the request and provide written confirmation detailing:

• Formal confirmation of the cancellation
• Applicable cancellation fees, if any
• Net refund amount and estimated processing schedule

5.3 No cancellation shall be deemed effective until formally acknowledged and confirmed in writing by Arabian Desert Safari LLC.

5.4 Approved refunds are credited back to the original method of payment (or client credit balance upon request) within 7 to 14 business days, subject to the interbank clearing timelines of your card-issuing institution.

6. Itinerary Amendments & Operational Safety

6.1 Operational Variables: Tour routes, schedules, safari camps, and itineraries are designed to optimize guest experience but remain subject to modification due to factors beyond our reasonable control, including adverse weather conditions (sandstorms, heavy rains, fog, high waves), public road closures, governmental directives, security alerts, and local regulations.

6.2 Desert Safari Safety: As the direct owner of our 4x4 Land Cruiser fleet and exclusive desert safari camps, guest safety is our paramount priority. Arabian Desert Safari LLC marshals and management reserve the right to alter dune-bashing intensity, adjust camp entertainment schedules, or reschedule desert excursions if adverse weather compromises passenger well-being.

6.3 Alternative Arrangements: Where significant operational changes are necessary, Arabian Desert Safari LLC will use all reasonable endeavors to provide an alternative activity of equal standard and value. Where a substantial modification materially alters the experience, you will be notified as promptly as possible.

6.4 Force Majeure Exemptions: No compensation or reimbursement beyond reasonable operational rescheduling shall be payable in respect of itinerary changes caused by events of Force Majeure (as defined in Section 11).

7. Hotel Accommodation and Check-In/Check-Out Policy

7.1 Where holiday packages include hotel accommodations, Arabian Desert Safari LLC acts to secure reservations at the selected property. In the event a property becomes unavailable due to overbooking or hotel operational emergencies, we will arrange alternative lodging of an equivalent or superior category.

7.2 Standard hotel check-in time across the UAE is typically 14:00 or 15:00 hours, and check-out is 11:00 or 12:00 hours. Early check-in or late check-out requests are subject to hotel discretion and room availability and cannot be guaranteed by Arabian Desert Safari LLC.

7.3 Any special guest preferences (such as non-smoking rooms, bed configurations, high-floor views, or interconnecting suites) will be relayed to the hotel management, but remain subject to hotel operational policies.

8. Health, Safety & Travel Insurance

8.1 Travel Insurance: Arabian Desert Safari LLC strongly advises all travelers to secure comprehensive travel and medical insurance prior to commencing their journey. Adequate insurance should cover emergency medical treatment, hospital care, emergency evacuation, trip cancellation, personal baggage loss, and travel delays.

8.2 Desert Safari & Adventure Activity Health Advisory: Certain adventure activities—including desert dune bashing, quad biking, dune buggy riding, camel rides, and speed boat tours—involve physical motion over rugged terrain. Therefore:

• Expectant mothers, individuals with chronic back, neck, spine, or joint ailments, and guests with severe cardiac or respiratory conditions are strictly advised against participating in dune bashing.
• Guests with medical conditions may still enjoy our desert safari camps by requesting direct gentle transfers on paved roads directly to the camp, bypassing dune bashing.
• Guests must adhere to the safety instructions of our DTCM-certified safari marshals, wear seatbelts at all times inside our 4x4 vehicles, and use supplied helmets/protective gear during quad bike and buggy sessions.

8.3 Arabian Desert Safari LLC shall not be liable for any personal injury, loss, illness, or damage sustained as a result of failure to disclose medical conditions, failure to adhere to posted safety instructions, or participation in voluntary adventure sports, except to the extent caused by our proven negligence.

9. Travel Documents and Entry Requirements

9.1 Responsibility: It is the sole responsibility of each guest to ensure they possess valid travel documentation required for transit and entry into the UAE, including:

• A valid passport with a minimum of six (6) months validity remaining from the intended date of entry
• A valid UAE visit, tourist, or transit visa corresponding to nationality requirements
• Proof of onward or return travel, and adequate accommodation confirmations
• Any mandatory health certificates, vaccination records, or travel authorizations mandated by UAE federal authorities

9.2 Arabian Desert Safari LLC cannot be held liable for any loss, cancellation fee, or expense arising from an invalid passport, lack of entry documents, or refusal of entry by UAE immigration and border control officials.

10. Direct Operations & Limitation of Liability

10.1 Direct Operator Scope: Arabian Desert Safari LLC operates its own private vehicle fleet and exclusive desert safari camps directly. For these direct operations, we maintain comprehensive commercial transport and public liability insurance in accordance with RTA and DET regulations.

10.2 Third-Party Service Providers: For services not directly owned by our group—such as third-party theme parks, commercial airlines, water parks, dhow cruise vessels, and third-party hotels—Arabian Desert Safari LLC acts solely as an authorized booking agent. We cannot be held liable for acts, omissions, defaults, or negligence of independent third-party operators.

10.3 Aggregate Liability Cap: To the maximum extent permitted by applicable UAE law, the total aggregate liability of Arabian Desert Safari LLC arising under or in connection with these Terms or any booked Service, whether in contract, tort (including negligence), or statutory duty, shall not exceed the actual amount paid by you for the specific Service giving rise to the claim.

10.4 Consequential Loss Exclusion: Under no circumstances shall Arabian Desert Safari LLC be liable for indirect, incidental, special, punitive, or consequential damages, including loss of business profits, loss of anticipated savings, emotional distress, or loss of enjoyment.

10.5 Statutory Rights: Nothing in these Terms shall limit or exclude liability for death or personal injury resulting from proven gross negligence, fraud, or willful misconduct, or any other liability that cannot be excluded under UAE consumer protection laws.

11. Force Majeure

11.1 Arabian Desert Safari LLC shall not be liable for any failure or delay in performing its contractual obligations where such failure or delay arises from events beyond our reasonable control (“Force Majeure”). Force Majeure events include, without limitation:

• Acts of God, natural catastrophes, sandstorms, severe floods, earthquakes, or extreme weather hazards
• Epidemics, pandemics, quarantines, or international public health emergencies
• War, military conflict, acts of terrorism, civil unrest, or political disturbances
• Government mandates, airspace restrictions, border closures, national curfews, or travel advisories
• Industrial strikes, labor disputes, port disruptions, or utility/telecommunications failures

11.2 In a Force Majeure event, Arabian Desert Safari LLC will make reasonable efforts to reschedule services, issue service credits, or minimize guest disruption. However, no monetary compensation or damages shall be payable for losses occasioned by Force Majeure events.

12. Intellectual Property and Digital Content

12.1 All content displayed on the Website—including text, graphics, brand logos, tour itineraries, photographic imagery, software code, videos, and layouts—is the exclusive intellectual property of Arabian Desert Safari LLC or its authorized licensors and is protected by UAE and international copyright and trademark laws.

12.2 You are granted a limited, revocable, non-exclusive license to view, download, and print materials from the Website solely for personal, non-commercial purposes in connection with booking or inquiring about our Services. Any unauthorized commercial copying, scraping, reproduction, modification, or public distribution without prior written authorization from Arabian Desert Safari LLC is strictly prohibited.

12.3 The trademarks and trade names “Arabian Desert Safari LLC,” “Arabian Desert Safari,” “ADS,” “Arabian Desert Safari,” “All UAE Tours,” “Royal Desert Tours,” and “DTTS” are proprietary assets of our corporate group and may not be utilized without prior written consent.

13. Indemnification

You agree to defend, indemnify, and hold harmless Arabian Desert Safari LLC, its shareholders, directors, officers, employees, safari marshals, drivers, agents, and group affiliates from and against any and all claims, damages, liabilities, losses, judgments, and expenses (including reasonable legal and attorney fees) arising out of or resulting from:

• Your breach or non-compliance with any provision of these Terms
• Your violation of any UAE federal, emirate, or international law, traffic regulation, or third-party rights
• Any intentional misconduct, property damage at our desert safari camps, or reckless behavior during tours and transfers
• Any inaccuracy, omission, or falsehood in the information provided during the booking process

14. Dispute Resolution & Arbitration

14.1 Amicable Settlement: In the event of any dispute, disagreement, or claim arising out of or relating to these Terms or the provision of Services, the parties shall first make good-faith efforts to resolve the dispute amicably through informal consultation and negotiation.

14.2 Mediation & Arbitration: If the dispute cannot be resolved amicably within thirty (30) days of formal written notice, either party may refer the matter to mediation or binding arbitration under the rules of the Dubai International Arbitration Centre (DIAC).

14.3 Seat & Language: The legal seat of arbitration shall be Dubai, United Arab Emirates, and the official language of all arbitral proceedings shall be English.

15. Governing Law and Jurisdiction

These Terms, and any contractual or non-contractual disputes arising hereunder, shall be governed by, construed, and enforced in accordance with the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates. Subject to the dispute resolution provisions in Section 14, the civil courts of Dubai, United Arab Emirates, shall have exclusive jurisdiction over any proceeding.

16. Severability

If any clause or provision of these Terms is determined by a court or arbitral tribunal of competent jurisdiction to be invalid, unlawful, or unenforceable, such determination shall not affect the validity or enforceability of the remaining provisions. The invalid provision shall be construed or reformed to the minimum extent necessary to achieve its original commercial and legal intent.

17. Entire Agreement

These Terms, together with our Privacy Policy, specific tour booking vouchers, and written corporate proposals, constitute the complete and entire agreement between you and Arabian Desert Safari LLC regarding the subject matter hereof, superseding all prior discussions, representations, promises, or understandings, whether oral or written.

18. Contact & Corporate Information

By confirming a booking or utilizing our Services, you acknowledge that you have read, understood, and voluntarily agree to be bound by these Terms and Conditions in their entirety.
